Pope leads Easter Mass in St. Peter's Square

VATICAN CITY (AP) ? Pope Francis celebrated his first Easter Sunday Mass as pontiff in St. Peter's Square, packed by joyous pilgrims, tourists and Romans and bedecked by spring flowers.

Wearing cream-colored vestments, Francis strode onto the esplanade in front of St. Peter's Basilica and took his place at an altar set up under a white canopy.

Faithful had already filled the square hours before the Mass began in mid-morning, and throughout the service streams of people kept flocking there for his speech and blessing, traditionally delivered after the Mass from the central balcony of the basilica.

By mid-ceremony, some 250,000 people had turned out, the Vatican said.

Francis bowed his head in reflection as the Gospel was sung in Latin, recounting what Christians believe is the central mystery of their faith ? the resurrection of Jesus after this death by crucifixion.

After heavy rain battered Rome during the night, more was forecast. But Sunday saw sunny skies alternate with clouds.

With Rome's chilly, rainy winter postponing the blossoming of many flowers until recently, the square was a welcome riot of floral color in the city. Sprays of yellow forsythia and daffodils and white lilies ? the colors of the Vatican flag ? dominated, but there were also bursts of lavender and pink, from potted azalea, rhododendron, wisteria and other plants.

Pope's Easter speech has been used by past pontiffs to reflect on the world's conflicts and ills.

Since Francis was elected pope on March 13, becoming the first Latin American and first Jesuit pontiff ever, he has put concern for the poor and others on the margins of society at the heart of his attention to set an example for his flock.

America: Time to shake the salt habit?

The love affair between U.S. residents and salt is making us sick: high sodium intake increases blood pressure, and leads to higher rates of heart attack and strokes. Nonetheless, Americans continue to ingest far higher amounts of sodium than those recommended by physicians and national guidelines.

A balanced review of the relevant literature has been published in the March 27, 2013 edition of The New England Journal of Medicine. Theodore A. Kotchen, M.D., professor of medicine (endocrinology), and associate dean for clinical research at the Medical College of Wisconsin, is the lead author of the article.

Dr. Kotchen cites correlations between blood pressure and salt intake in a number of different studies; typically, the causation between lowering salt intake and decreased levels of blood pressure occur in individuals who have been diagnosed with hypertension. Although not as pronounced, there is also a link between salt intake and blood pressure in non-hypertensive individuals. Additionally, recent studies have demonstrated that a reduced salt intake is associated with decreased cardiovascular disease and decreased mortality.

In national studies in Finland and Great Britain, instituting a national salt-reduction program led to decreased sodium intake. In Finland, the resulting decrease in systolic and diastolic blood pressures corresponded to a 75 ? 80 percent decrease in death due to stroke and coronary heart disease. Neverthelesss, not all investigators concur with population-based recommendations to lower salt intake, and the reasons for this position are reviewed.

"Salt is essential for life, but it has been difficult to distinguish salt need from salt preference," said Dr. Kotchen. "Given the medical evidence, it seems that recommendations for reducing levels of salt consumption in the general population would be justifiable at this time." However, in terms of safety, the lower limit of salt consumption has not beeen clearly identified. In certain patient groups, less rigorous targets for salt reduction may be appropriate.

Lockheed Martin's technology hub brings startups closer to government needs

Wondering who would be the first to concoct a Kickstarter for governmental wishes? We suppose it's Lockheed Martin. Today, the aforementioned outfit has launched an initiative "aimed at expanding its collaboration with Silicon Valley companies to meet the diverse technology needs of the federal government." Called the Lockheed Martin Silicon Valley Alliance, the hub will reportedly "provide the federal government with greater visibility into innovative technology solutions developed locally," even going so far as to suggest that a game developer could use their resources in order to improve the realism of a military simulation system. It sounds as if Lockheed will end up being the middleman between aspiring companies and entities like the Department of Defense and NASA, essentially ensuring that whatever is built meets federal requirements. Those interested in venturing down such a rabbit hole can give the source link a look, but as always, we'd caution you to register at your own risk.

eBay's Sell it Forward splits auction proceeds with Goodwill

eBay's latest initiative is a little different from its more recent efforts that have focused mostly on re-branding and expanding the reach of PayPal. Sell it Forward encourages users to sell their used clothes and donate half the proceeds to Goodwill. The pilot program is currently only available in San Francisco, San Mateo, and Marin, though the company is going out of its way to make the process as painless as possible for those in eligible areas. Instead of creating listings for each item, wannabe auctioneers need only fill the pre-paid mailing bag (provided by eBay) with the clothes and accessories they wish to sell. Everything else will be taken care of for them. Employees will decide if your wares are in decent enough condition to sell, create a listing and, if the item is sold within 14 days, split the proceeds between the "seller" and Goodwill. Is Fuel From Carbon Dioxide Too Good to Be True?

It?s almost as impressive as pulling a rabbit out of a hat?except this presto chango trick is for real and has the potential to help combat the effects of global warming.

Researchers at the University of Georgia have come up with a way to transform carbon dioxide trapped in the atmosphere into useful industrial products. Science Daily?reports that the discovery could lead to the creation of biofuels made directly from the carbon dioxide.

The work was supported by the Advanced Research Projects Agency-Energy Electrofuels program of the Department of Energy.??The goal of the project is to use hydrogen gas to directly convert carbon dioxide into a liquid fuel,? Professor Michael Adams of UGA?s Bioenergy Systems Research Institute told TakePart.

Adams, whose work was part of a collaborative project with the research group of Professor Bob Kelly at North Carolina State University, explains that the technology is similar to the process of photosynthesis in plants, but focuses on a microorganism called Pyrococcus furiosus.

?Pyrococcus grows optimally in boiling water (100?C) but does not use carbon dioxide,? says Adams.??We genetically engineered it to use carbon dioxide and hydrogen gas but to do so very efficiently at much lower temperatures (near 70?C) where the organism itself has little activity?it is in a cold shock?and should not interfere with the process.?

?In a paper published this week in the Proceedings of the National Academy of Sciences we demonstrated proof of principle and showed that Pyroccocus would use hydrogen gas and incorporate carbon dioxide into an important industrial chemical used to make plastics and other materials. We are now genetically engineering Pyrococcus to generate fuels solely from hydrogen and carbon dioxide.?

The fuel created by the bacteria releases the same amount of carbon dioxide used to create it, essentially rendering it carbon neutral.

Adams and his team are hoping to refine the process and begin testing it on larger scales. ?All of this work is on the laboratory scale,? he says. ?We are now optimizing the ability of genetically engineered Pyrococcus to use hydrogen and carbon dioxide for fuel production and will then begin to go to larger scales for demonstration purposes.?

If they?re successful, they will have come up with what?s known as a formula for turning a negative into a positive.

    Coney Island's coaster back, even if it isn't

    The Cyclone in Coney Island (Holly Bailey/Yahoo News)BROOKLYN, N.Y.?Erik Knapp was just 7 when he took his first turn on the Cyclone, Coney Island?s famed wooden roller coaster. His mother had insisted that he was too young to ride the old rickety coaster, but his grandfather took him anyway, and to hear Knapp tell it, it was love at first ride.

    In the years since, Knapp, who is now 47, estimates he?s ridden the coaster ?at least 2,000 times? and says he?ll ride it until the day he dies. As proof, he points to a gigantic tattoo of the Cyclone he had inked on his right bicep many years ago. It?s a permanent depiction of the coaster?s iconic red Cyclone sign and a train of passengers falling on the ride?s first major drop. Seated in the front seat alone is a skeleton.

    ?That?s me,? Knapp says, grinning. ?This ride is such a part of my life. I have never lost the thrill of it, and I don?t think I ever will.?

    But in October, Knapp worried he might lose his beloved ride forever in the fierce winds and flooding of Superstorm Sandy. A massive nine-foot storm surge wiped out many businesses along Surf Avenue, Coney Island?s main strip, and flooded the 86-year-old coaster. But unlike the Jet Star, the coaster in Seaside Heights, N.J., which collapsed into the sea and became an iconic image of Sandy?s devastation, the Cyclone stayed put. And on Sunday, it reopened?along with the Wonder Wheel Ferris wheel and the rest of the amusement park that city officials once feared might not be able to recover in time for this summer.

    ?Coney Island is open!? Brooklyn Borough President Marty Markowitz declared as he and Sen. Chuck Schumer christened the Cyclone?s reopening by smashing a wine bottle full of egg cream on the ride?s first car.

    But all around Coney Island, there are still signs of Sandy?s wrath.

    Down the block, the original location of Nathan?s Famous hot dogs remains closed. Its customers have been rerouted to another location on the boardwalk as it tries to reopen later this spring. Coney Island USA, home to vintage games and a freak show, is still closed after flooding caused more than $400,000 in damage to its historic building. And the nearby New York Aquarium also remains closed after heavy damage. Staff there say they hope to reopen by May.

    On Sunday, across the street from the Cyclone, about a dozen local residents quietly protested the hype surrounding the amusement park?s reopening. Waving signs that read ?People Live Here? and ?Coney Island is Not Back,? they accused city officials of focusing more on getting the rides open than helping to rebuild the rest of the neighborhood.

    ?In a lot of buildings, we still don?t have heat. We don?t have a library. We don?t have a police station. We don?t have a post office,? said Dana Monroe of the People?s Coalition of Coney Island, which organized the protest. ?Where are the grand openings for things that actually help the people who live here??

    Jeri Gventer, who works with seniors who live on the west end of Coney Island, complained that many of the senior centers in the neighborhood remained without needed repairs. In one building, the elevator has been out of service since Sandy?a big deal because many elderly residents can?t climb stairs very well, if at all.

    ?This neighborhood is very poor,? Gventer said. ?We can?t do these things without help. And we just feel ignored.?

    Across the street, Markowitz said he sympathized with their plight?and blamed delays in receiving state and federal aid as the reason for the slow recovery in the neighborhood. He pointed out that the Cyclone and the rest of the amusement park had opened so quickly in part because the owners of the facility had used their own money to make repairs instead of waiting for public help.

    But Markowitz insisted the amusement park would help Coney Island?s recovery because many of its employees live in the neighborhood, and it would likely spur additional redevelopment. But, he added, that doesn?t mean the job in Coney Island is done.

    Motioning to the protesters, Markowitz said, "It's right for them to be here, so they put right in front of those that have that responsibility, which is Sen. Schumer, the Assembly, the Senate, Congress, City Council, borough president, all of us, to make sure that we stay focused on resolving their needs.?

    But for Knapp, the Cyclone?s return was more than just the reopening of his favorite thrill ride. In October, his home in nearby Gerritsen Beach suffered severe flooding in Sandy, and he said he's spent the past five months slowly trying to rebuild and recover from the storm.

    ?The Cyclone coming back is not just an important symbol of recovery for the neighborhood, it?s important to me. It gives me a sense of normalcy,? Knapp said.

    So on Saturday night?as he has for the past eight years?Knapp got in line outside the Cyclone at just after 8 p.m. so that he could be the first to ride the coaster on its reopening day. He camped outside with a group of friends.

    Just after noon on Sunday, he bounded up the roller coaster's entrance ramp and jumped into the train?s first car, where he proudly showed a group of reporters his Cyclone tattoo and the word ?CYCLONE? shaved into his hair. He was so excited he could barely sit still.

    ?Last night was one of the coldest nights I?ve ever spent out here, but it was worth it,? Knapp said. ?I love the Cyclone. I love Coney Island. It feels good to be back.?

    BRUSSELS (AP) ? Feel like having chocolate at Easter in Belgium? Well, send a letter and really lick that chocolate-flavored postal stamp.

    The Belgian post office released 538,000 stamps on Monday that have pictures of chocolate on the front but the essence of cacao oil in the glue at the back for taste and in the ink for smell.

    Belgian stamp collector Marie-Claire Verstichel said while the taste was a bit disappointing, "they smell good."

    Easter is the season for chocolate in Belgium with Easter eggs and bunnies all over supermarkets and speciality stores.

    A set of five stamps costs 6.2 euros ($8) but might leave a customer hungry for more.

    Yankees' Jeter expected to start season on DL

    (AP) ? Derek Jeter will likely join Alex Rodriguez, Mark Teixeira and Curtis Granderson on the New York Yankees' star-studded disabled list for the season opener against the Boston Red Sox on April 1.

    Yankees general manager Brian Cashman says it's "more likely than not" Jeter will start on the DL because of a sore left ankle, still recovering from surgery last October.

    "April 1 is unrealistic in my mind now," Cashman said Sunday. "There's nothing new going on other than growing pains as he gets through these final hurdles of his rehab."

    Eduardo Nunez, known for his bat more than his glove, would fill in at shortstop for the 13-time All-Star, who broke the ankle Oct. 13 during the AL championship series opener against Detroit and had surgery a week later.

    The 38-year-old, who has repeatedly vowed to be ready for opening day, played in his first big league spring training game on March 9 as a designated hitter. He returned to shortstop four days later, then played consecutive games on March 15 and 16 before inflammation kept him out of the lineup.

    He received an anti-inflammatory injection Wednesday and had four at-bats as a DH Saturday in a minor league exhibition game.

    "I know Derek extremely well, and I can read his face," Cashman said. "And his face today tells me that the reality of his circumstances is starting to sink in, and the disabled list might be necessary. I told him what I think, and he didn't fight me on it. That's reality."

    Jeter is 3 for 11 with a double in five spring training games. New York could put him on the DL backdated to Friday, meaning he could be activated on April 6, when the Yankees are at Detroit.

    "It's a goal, it doesn't mean an absolute," Cashman said. "We'll respond to how he's feeling. That's all we can do. At some point this will be behind him."

    Cashman wants Jeter to be available to play the field when he's on the active roster.

    "We have to get him to be able to play shortstop," Cashman said. "I don't think it's going to get him healthy DHing for us."

    Jeter has not been on the DL for opening day since 2001, when he missed the first four games after straining his right quadriceps during a spring training game that March 16. Two years later, he dislocated his left shoulder in the opener during a collision at third base with Toronto catcher Ken Huckaby, who was covering the bag. Jeter was sidelined until May 13.

    Seeking their 18th playoff berth in 19 years, the Yankees' batting order figure to be missing almost half its regulars when the season starts.

    Rodriguez isn't expected back until after the All-Star break following left hip surgery on Jan. 16. Teixeira hasn't ruled out missing the first two months of the season because of a partially torn tendon sheath in his right wrist, an injury sustained while taking swings off a tee with the U.S. at the World Baseball Classic on March 5. Granderson is expected to be out until the first week of May after breaking his right forearm when he was hit by a pitch from Toronto's J.A. Happ on Feb. 24 in his first spring training at-bat.

    In addition, New York allowed Nick Swisher, Raul Ibanez, Russell Martin and Eric Chavez to depart as free agents.

    LONDON (AP) ? Chemical and radiation experts found no hazardous materials in their search of the property where Boris Berezovsky's body was found, as British police on Sunday investigated the unexplained death of the self-exiled Russian tycoon who went from Kremlin kingmaker to fiery critic.

    Berezovsky, who fled to Britain in the early 2000s after a bitter falling out with Russian President Vladimir Putin, was found dead Saturday at the property in Ascot, a town 40 kilometers (25 miles) west of London. He was 67, and Thames Valley police say his death is being treated as "unexplained."

    Police said Sunday that officers specially trained in chemical, biological, radiological and nuclear materials have given the scene the "all clear."

    "Officers found nothing of concern in the property and we are now progressing the investigation as normal," a statement from police said, adding that the majority of the cordon put in place around the property has now been lifted.

    Berezovsky ? who had survived a number of assassination attempts ? amassed a fortune through oil and automobiles during Russia's chaotic privatization of state assets following the collapse of the Soviet Union in the early 1990s.

    Once a member of Russian President Boris Yeltsin's inner circle, Berezovsky fell out with Yeltsin's successor, Putin, and fled Britain in the early 2000s to escape fraud charges that he said were politically motivated.

    He became a strident and frequent critic of Putin, accusing the leader of ushering in a dictatorship, and accused the security services of organizing the 1999 apartment house bombings in Moscow and two other Russian cities that became a pretext for Russian troops to sweep into Chechnya for the second war there in half a decade.

    Putin's spokesman acknowledged Sunday that the Russian president considered Berezovsky an enemy with clearly stated intentions to fight.

    "We know for certain that he spared no expense in support of processes, within Russia and beyond, that could be said to have been directed against Russia and Putin," spokesman Dmitry Peskov said on the independent cable television channel Rain. "He definitely was Putin's opponent, and unfortunately not only his political opponent, but most likely in other dimensions as well."

    In recent years, Berezovsky fended off legal attacks that often bore political undertones ? and others that bit into his fortune.

    Russia repeatedly sought to extradite on Berezovksy on a wide variety of criminal charges, and the tycoon vehemently rejected allegations over the years that he was linked to several deaths, including that of slain journalist Anna Politkovskaya and ex-KGB agent Alexander Litvinenko.

    Berezovsky won a libel case in 2010 against a Kremlin-owned broadcaster that aired a show in which it was suggested he was behind the poisoning of Litvinenko, who had fled Russia with Berezovsky's help after accusing officials there of plotting to assassinate political opponents.

    He took a hit with his divorce from Galina Besharova in 2010, paying what was at the time Britain's largest divorce settlement. The figure beat a previous record of 48 million pounds ($73.1 million) and was estimated as high as 100 million pounds, though the exact figure was never confirmed.

    Last year, Berezovsky lost a multibillion-pound High Court case against fellow Russian Roman Abramovich and was ordered to pay 35 million pounds ($53.3 million) in legal costs.

    Berezovsky had claimed that Abramovich, the billionaire owner of Chelsea Football Club, cheated him out of his stakes in the oil group Sibneft, arguing that he blackmailed him into selling the stakes vastly beneath their true worth after he lost Putin's good graces.

    But a judge threw out the case in August, ruling that Berezovsky was a dishonest and unreliable witness, and rejected Berezovsky's claims that he was threatened by Putin and Alexander Voloshin, a Putin ally, to coerce him to sell his Sibneft stake.

    It also recently emerged that Berezovsky ran up legal bills totaling more than 250,000 pounds in just two months of a case against his former partner, Elena Gorbunova, with whom he had two children and who claimed the businessman owed her millions.

    Earlier this week, The Times of London newspaper reported that Berezovsky was selling property ? including an Andy Warhol portrait of the former Soviet Union leader Vladimir Lenin ? to settle his debts and pay expenses owed to lawyers.

    News of Berezovsky's death has prompted conspiracy theories along with speculation as to his state of mind, given his recent financial setbacks.

    Ilya Zhegulev, a journalist with the Russian edition of Forbes magazine, said he spoke with Berezovsky the day before he died and discussed the tycoon's decision to flee Russia in 2000.

    The journalist quoted Berezovsky as saying that during his years in London he had lost the meaning of life.

    "I no longer want to be involved in politics," Zhegulev quoted Berezovsky as saying in a story published Saturday on the Forbes.ru website.

    He said Berezovsky told him that he wanted nothing more than to return to Russia. The former oligarch said he had changed his views on Russia, saying he now understood that it should not look to Europe as a model.

    "I had absolutely, idealistically imagined that it was possible to build a democratic Russia. And idealistically imagined what democracy was in the center of Europe. I underestimated the inertia of Russia and greatly overestimated the West. This took place gradually. I changed my understanding of Russia's path," he quoted Berezovsky as having said.

    Delaying savings will only make problem worse: ECB's Praet

    BRUSSELS (Reuters) - Savings required to bring euro zone budgets under control cannot be put off for long, European Central Bank Executive Board member Peter Praet said in an interview in two Belgian newspapers.

    Economists such as Nobel prize-winning Paul Krugman and London School of Economics professor Paul De Grauwe have said austerity measures in southern euro zone countries are simply driving them into a downward spiral of recession and debt.

    Praet, in an interview published on Saturday in Dutch-language De Standaard and French-language Le Soir, said one should be careful about thinking this way.

    "You can have a little delay. But you will not solve the problem that way. Quite the contrary, a delay will only make your debt mountain bigger. And it needs to stay manageable," Praet said.

    Praet told the newspapers that if there were signs of economic recovery soon then necessary reforms and savings could not be put off for a year.

    "I hear far too much policymakers saying: wait a little, give me more time. That can affect the credibility of a country. The debts will not miraculously disappear," he said.

    He said savings were not a 'dogma' for the European Central Bank. What was important, he said, was the impact of savings measures, which should be combined with structural reforms.

    Praet said he expected the euro zone to have contracted in the first quarter of 2013. The recession overall was not deep, although the difference between countries was sharp.

    Praet also said he was pre-occupied with two chief concerns.

    Consumers were concerned that their income over the long term would fall and were cutting spending, which was making the problem worse.

    His second concern was that banks were receiving cheap money, such as from the European Central Bank, but were not passing this on as credit to companies.

    "Big multinationals do not draw little of this. They can get financing directly from the market by issuing corporate debt. But for the many small and medium-sized firms this is a problem," he said.

    BILL NUMBER:S4307  TITLE  OF  BILL:    An act to amend the tax law and the administrative code of the city of New York, in relation to suspending the income tax refund  statute  of  limitations  for  individuals  due  to  financial disability  Purpose of Bill:  The  bill  would  suspend  (toll)  the  statute  of limitations for an "individual taxpayer" who to file a claim for an income tax credit  or refund  during  a period when an individual is unable to manage his or her financial affairs due to a severe physical  or  mental  impairment ("financial disability").  Summary of provisions:  Section  1  of  the  bill  would  re-letter  current subsection (k) of section 687 of the Tax  Law  to  be  subsection  (l)  and  add  a  new subsection (k).  Proposed paragraph (1) of new subsection (k) would suspend the statute of  limitations  for  an  "individual  taxpayer" to file a claim for a state or local income tax credit or refund during any period when that individual is "financially disabled?." An individual  taxpayer  is  an individual who is subject to any State or local personal income tax or surcharge administered by the Commissioner of Taxation and Finance.  Proposed  paragraph  (2)  of  new  subsection  (k)  provides  that  an individual taxpayer would be considered "financially disabled"  if  he or she is unable to manage his or her financial affairs by reason of a medically  determinable  physical  or  mental  impairment which can be expected to result in death or which has lasted or can be expected  to last  for a continuous period of not less than twelve months. Proof of the existence of such impairment would be provided  in  the  form  and manner required by the Commissioner of Taxation and Finance.  Proposed  paragraph  (3)  of  new  subsection  (k)  provides  that  an individual taxpayer would  not  be  treated  as  financially  disabled during  any period that the individual's spouse or any other person is authorized to act on behalf of such individual in financial matters.  Section 2 of the bill provides that  a  similar  new  subdivision  (k) would  be  added  to section 11-1787 of the Administrative Code of the City of New York for purposes of the New York City personal income tax on residents.  Section 3 of the bill provides that it would take effect  immediately, and apply to periods of financial disability commencing before, on, or after  the  date  of  enactment,  but would not apply to any claim for credit or refund that without regard to this bill, would be barred  by the operation of any law or rule of law (including res judicata) as of the  date  of  enactment.  Therefore,  these  provisions  would not be applicable to claims for which the statute of limitations  to  file  a claim  for  a  credit or refund has expired, or where there has been a final decision on the merits of the claim as of the date of enactment.   Existing law:  This  bill  would amend the Tax Law and the Administrative Code of the City of New York to include provision's similar to section 6511(h)  of the  Internal Revenue Code. This would allow the statutory time period to file a claim for a credit or refund of state and local income taxes to be suspended (tolled) during a period when an  individual  taxpayer is  "financially  disabled"  which  is  not currently permitted in New York.  Prior Legislative history:  This is a new proposal.  Statement in support:  In the United States Supreme Court case of US v Brockamp, 518 U.S. 347 (1997), the taxpayers were disabled  by  senility  or  alcoholism  and failed  to  file  timely  federal  refund  claims.  The  Supreme Court rejected the argument that the refund statute of  limitations  in  the Internal  Revenue  Code  could  be  tolled  for equitable reasons. The Internal Revenue Code was subsequently amended by adding a  subsection (h)  to  section  6511  to  allow  for  tolling of time for individual taxpayers to file a claim for credit or refund when they are unable to take care of their financial affairs because of  a  severe  mental  or physical impairment.  Because the New York personal income tax refund statute of limitations provisions  in  section 687 of the Tax Law (and the similar provisions in section 11-1787 of the Administrative Code of the City of New York) were not similarly amended to include the equitable tolling provisions of section 6511(h) of the Internal Revenue Code, the  holding  in  the Brockamp  case  is  still  good  law  in New York. The New York refund statute  of  limitations  provisions  are  among  various  income  tax procedural  provisions  derived  from comparable federal provisions in order to "avoid injustices resulting from differing Federal and  State remedies   where   the  substantive  law  is  similar  or  identical." (Memorandum of State Department of Taxation and  Finance  for  Chapter 1011  of  the Laws of 1962.) Therefore, the New York refund statute of limitations provisions should be amended to include equitable  tolling provisions  similar  to  the  federal  provisions  since  it  would be equitable for New York personal income taxpayers to be  able  to  take advantage  of  the same equitable tolling provisions available to them on the federal level.  Budget implications:  It is estimated that this bill will result in a decrease  of  $750,000 in revenue for SFY 2013-14.  Local Impact:  None.  Effective Date:  The bill would take effect immediately.

    Section 1. Subsection (k) of section 687 of the tax law is relettered subsection (l) and a new subsection (k) is added to read as follows:
    (K) RUNNING OF PERIODS OF LIMITATION SUSPENDED WHILE TAXPAYER IS UNABLE TO MANAGE FINANCIAL AFFAIRS DUE TO DISABILITY. -- (1) IN THE CASE OF AN INDIVIDUAL TAXPAYER, THE RUNNING OF THE PERIODS SPECIFIED IN SUBSECTIONS (A), (B), AND (C) OF THIS SECTION SHALL BE SUSPENDED DURING ANY PERIOD OF SUCH INDIVIDUAL'S LIFE THAT SUCH INDIVIDUAL IS FINANCIALLY DISABLED. FOR PURPOSES OF THIS SUBSECTION, AN INDIVIDUAL TAXPAYER IS AN INDIVIDUAL WHO IS SUBJECT TO ANY STATE OR LOCAL PERSONAL INCOME TAX OR SURCHARGE ADMINISTERED BY THE COMMISSIONER. (2) FOR PURPOSES OF PARAGRAPH ONE OF THIS SUBSECTION, AN INDIVIDUAL TAXPAYER IS FINANCIALLY DISABLED IF SUCH INDIVIDUAL IS UNABLE TO MANAGE HIS OR HER FINANCIAL AFFAIRS BY REASON OF A MEDICALLY DETERMINABLE PHYS ICAL OR MENTAL IMPAIRMENT OF THAT INDIVIDUAL WHICH CAN BE EXPECTED TO RESULT IN DEATH OR WHICH HAS LASTED OR CAN BE EXPECTED TO LAST FOR A CONTINUOUS PERIOD OF NOT LESS THAN TWELVE MONTHS. AN INDIVIDUAL SHALL NOT BE CONSIDERED TO HAVE SUCH AN IMPAIRMENT UNLESS PROOF OF THE EXIST ENCE THEREOF IS FURNISHED IN SUCH FORM AND MANNER AS THE COMMISSIONER MAY REQUIRE.
